property fraud
my landlord died and now someome clamining to be his laywer brought a 5 day notice in sept 2004 and requesting rent from the tenants in the building. We as tenants let him know that we didn't believe that the guy he brought by was the new owner, so they went away until feb 2005 and now has recently served use with a ten day notice and still requesting rent and security deposit. he also gave us a letter with supposed to be copy of the deed which is not, the papers are actually paperwork where the (deceased) family has property in probate court. now they are harrassing us for rent. we also found out that they are requesting different amounts in rent from each tenant when we all paid the same amount in the beginning.

If you have been paying your rent as stated in your lease then you have nothing to worry about. I would try to contact the family of your deceased landlord and find out what is going on. I would also make sure you have receipts or copies of the canceled checks for past rent payments. You will need these if this matter goes to court. Remember this person can not evict you without a court order and for them to obtain a court order they would have to file an eviction suit against you, have you served and appear in front of a judge to show you are in violation of your lease. If you are served with a summons the court date will appear on that summons and you must be at that court date or the judge will enter a order of possession for the apartment.
