Legal Question in Landlord & Tenant Law in Illinois

I was recently in the hospital and while I was there, my roommate packed up my clothes and took them to a relatives house one town over. She told me not to come home. I have lived there for over 2 years. And now she wont give me any more of my belongings. Is this legal? I would like to have my stuff back. I was told she couldn't just move me out like that. what can I do?

1. If you can prove the property is yours, you can file a police report for theft, but then it's up to the police to decide if they feel they can get involved.

2. If you can prove the property is yours, you can file a lawsuit for "replevin" or "conversion" which means you have a greater right to possess the property.

It might be easier for an attorney to make a demand on the roommate to surrender the property to you (or to the attorney for you); that might spark the roommate to do something to avoid needless litigation. If the roommate has any claim on the property, however, things could change.
