Legal Question in Landlord & Tenant Law in Illinois

Hi. I rent an apartment on Dupage County, Illinois, I paid monthly and never delinguent. I have a sign lease until Aug 1, 2013. I have been preapproved for a home loan, so Im searching and possibly purchasing a home within the next few months. So, by purchasing a home, does that automatically void the lease, meaning I can move without any problems and still be able to get my deposit back.

Absolutely NOT unless your lease gives you the right to terminate it for this reason. You need to either find an attorney who can help you negotiate a right to terminate or you can, but if the lease is solid without any such rights, you are at the landlord's mercy. That being said:

1. there are some times of the year that are "easier" for landlords to rerent and so if you talk to the landlord maybe the landlord will agree to allow you to terminate at such a time.

2. You should have an attorney look at the lease; you may be able to sublet the apartment for the balance of your term and if you find an acceptable replacement the landlord may even consider letting you off if the substitute signs up for a longer term, but there are no guarantees.
