Rent Deposit

I moved out of my apartment on 7-31-7 my landlordgave me me my deposit check in 2 checks for the total of 2000.00 he 3 days later put a stoppayment on one of the check,totaling anamount of 1000.00 and since then my account has been overdrawn. I called the landlord and he states that he is keeping the 1000.00 because the rugs were dirty, said to me not to call him again and hung up the phone, can i sue him for not returning my check and also for putting the stop payment i was charged 509.00 for charges on my account for NSF. Can you please help.

You can sue him for return of the security deposit plus penalties including court costs, interest and attorney's fees if he did not submit a written invoice outlining what he thought you damaged and the costs to repair same. You may even be able to get more depending on what municipality you lived in and what kind of building it was. You probably can get back whatever the bank charged you in fees for the bounced check but unlikely you will get the other fees back since you are not supposed to write checks if the money is not cleared in your account.
