i have roomate that its been over 3 months and dont pay rent at all. how can i kick him out of the house legally?

Statutory eviction. What kind of legal (written) notice will depend on whether you have a written lease, whether the room mate signed it along with you, and a bunch of other things. Without more information, however, nobody can point you to the correct notice, which will be the first step in an eviction lawsuit.
