security deposit

We moved Novemeber 1st, 2003. I told my landlord in September we would be moving and she said I needed to write her a note and give it her so I did. It has been a month a we still haven't recieved out deposit back so we called her. She claims that we dated the note for October 2nd which wasn't a 30 day notice since we moved the 1st and because she didn't rent out the apartment we don't get our deposit back. Our deposit was $100 more then our rent was and I would like to get at least my amount of rent back. She can keep the extra $100 for carpet cleaning and such. What can I do?

You can sue for the remainder. It is also possible that you may be entitled to more than your secrity deposit, attorneys' fees and court costs. Depends on more facts.
