Legal Question in Landlord & Tenant Law in Illinois

Security Deposit

I rent an apartment in Cicero, Illinois. Over the course of my stay, my landlord has been less than curteous in our dealings. Lately he has wanted to enter our apartment to inspect it for no reason. We have told him that we know our rights. He has also insulted a guest of my house. It has become stressful to the point where we need to move out in a matter of weeks rather than the 30 days required. My question is, am entitled to any of my security deposit when I move out? Is it pretty much a lost cause. I have a month-to-month word-of-mouth agreement with him. Thank you in advance.

Re: Security Deposit

You are entitled to your security deposit although you are required to give 30 days notice since that is the term of your agreement. After you move, he must send you an itemized account with receipts showing alleged damages to the property if he chooses to retain any of your security deposit. He has a total of 45 days to return your deposit.
