Legal Question in Landlord & Tenant Law in Illinois
can I go to small claims court?
I had my belongings in--name removed--storage unit and the roof leaked. I had--name removed--piano, love seat and 2 of my antique dining chairs and one side of china cabinet ruined. I told the landlord about it, he saw the damage and he told me that the (storage unit) is not responsible for the damage even though the whole roof peak had come up. I have gone back and forth with this guy for months. He even went as far as saying he would pay for the repair of my damaged dining chairs out of his pocket because the corporation won't pay. I was wondering if I have--name removed--case to take him to small claims court?

Re: can I go to small claims court?
Yes, you have a pretty good case as long as you did not sign away liability in your rental contract.
Depending on what your rental contract says, and the details of how the damage happened, you have a strong case to recover something for the value of your damaged furniture.
Please feel free to contact us if you want to talk about the details of your case.
