Legal Question in Landlord & Tenant Law in Illinois
Being Sued For Something I Don't Owe
I am being sued by a previous apartment rental company. I do owe them some of the money, but they have also tacked things on to the bill that I do not owe. They have replaced the carpet, refrigerator, couch, and various other things saying that I have done damage to them, but this is not true. How do I fight this.

The first thing you have to do is too make sure that you appear in court. The appartment rental firm is going to have to present bills and possibly work orders to the judge in order to prove damages.
You will be allowed to ask the representative questions regarding the nature of the work and also question the alleged damages to the items. Ask them how long the items were in the apartment and how many renters previous to you used those items and when was the last time up to now were those items replaced due to damage. I would also ask if the rental firm has photos of the damaged items.
When you moved out did the rental management provide you with a "move out form". If so make sure you bring that to court with you.
