Legal Question in Landlord & Tenant Law in Illinois

Tenant has not paid rent for over a year for a parking spot. She was on a monthly lease. She left for Mexico probably over a year ago. Left many messages on her cell pfone with no return call. Send all rent notices to her in Mexico and still no response. Can I apply for abandoned vehicle and sell it to try to recoup losses?

If you did not terminate the lease properly, it most likely rolled over month to month. It may also depend on whether you own the parking space or it is in a common area or condo common element.... The most conservative approach, for your protection, would be following the rules on forcible entry and detainer (eviction notice) followed by a lawsuit for possession. Since you apparently don't know where to serve her any notice, you most likely will not be able to get a money judgment for unpaid rent. Have you tried the post office to see if she left a forwarding address; you might be able to notify her by means of some kind of secure return receipt type of mailing, which would be good.
