tenants and lease agreement
My son and his cousin signed a one
year lease on Aug 1st, 2007 for an
apartment. The cousin has decided
to move out and live with someone
else. There are 8 months left on the
lease. Legally, isn't she still
responsible for her portion of the
rent based on her signing the lease
agreement? Does my soen have any
recourse to force her to pay her
share?

Unless the lease says she is only responsible for half of the rent, she is actually legally responsible for the entire rent as is your son. Regardless, she is still bound by the terms of the lease. There are probably provisions therein for subleasing in a case like this which is probably what she will need to do. Your son can sue her for her portion if she refuses to pay.
