tenants won't move out

hi im buying a two flat building in chicago i hve closing at middle october i need both apprtement empty from tenants but only one can be empty at closing the other one we dont know when and the owner he dont konw too he says the guy is never at home so he cant give him a notice but the guy is not willing to move out im scared to buy thehome he is not gona pay the rent i need to pay the mortgage im short on money and guy has no money enyway he is gona stay there until the law moves him out what can i do i can move closing date becouse my rate is locked if i move im gona hav higher rate i need the to be emptyat closing or one monty after maxwhat can i do before i buy from my side and what should the seller do to help this proces please help any advise what do i need to do

You need to review your contract to get an answer - my advice, get an attorney. The seller should be already suing him for eviction.
