Legal Question in Legal Ethics in Illinois

Notary Pubic Laws

I have been a notary public in the state of Illinois for years. My supervisor always told me that I could notorize a signature over the phone, if I knew the person well, and they verified they signed a document. Is that correct? If not, what is the penalty?

Re: Notary Pubic Laws

You have to have the person present in order to verify the signature belongs to that person - no exceptions. You could be guilty of a misdemeanor if you've been notarizing people over the phone.

Check the statute that applies to notaries: 5 ILCS 312 et seq.
