I am sorry to hear about your diagnosis. Of course, the delay may or may not have an effect on the final outcome. The only way to know that is to view your entire medical record and have it evaluated by a physician who will be then able to tell us whether your doctor or any doctor has failed to uphold the standard of care in the community in which they practice.

There is no easy way to this. You must order your medical records from ALL your providers and doctors and take it to your attorney's office and have them look at it.

My office regularly handles cases of this sort. Even if you do not contact my office, you should take your medical records to a lawyer for evaluation.

In my experience, in most cases of breast cancer the delay you ask about usually does not cause any exacerbation of the underlying problem. But, of course, I am not an oncologist, and there very well might be cases where an especially aggressive type of cancer spreads during the delay. In order to really get an answer for your question, an attorney would have to obtain all of the medical records and have them reviewed by a medical expert to determine whether the care you received failed to meet the standard of care for your community and also whether it caused any damage. Finally, a decision would have to be made whether the amount of damages recoverable through a lawsuit would justify the expense and effort of taking this matter to court. I have co-counselled with attorneys in Illinois who handle medical negligence cases, so I could refer you to someone far more experienced than myself. I personally know quite a bit about what you must be going through, and you have all of my compassion. I hope that you are aware that your diagnosis is not a death sentence and that there are many thousands of women who are "survivors" of breast cancer. The battle is often long and extremely difficult, but you can and will make it!
