Legal Question in Medical Malpractice in Illinois
a dentist gave me a root canal
A dentist recommended that I have a filling replaced-there was no pain from this filling. Afterwards there was a lot of pain, the dentist told me that it was because of the medicine they put in, give it a couple of days. A couple of days later the pain is worse, so they pollished it and when the pain didn't leave they told me to give it a month. I went to a different dentist and he told me that they went too deep with the replacment filling and that now I needed a root canal. He told me that they should not have removed the filling if there was no pain and that if they had a particular tool they would have seen my nerve endings were longer than usual and could have avoided going too deep causing the need for the root canal. Do I have any kind of case?

In Illinois in order to find out whether you have a case of medical malpractice, you must have your medical record reviewed by a competent doctor (in your case a DDS). The doctor must be of the opinion that given the circumstances, your uniquely long nerves and many other factors, the doctor failed to follow the standard of care and his failure caused injury to you.
Without such an opinion you have no case.
