Legal Question in Medical Malpractice in Illinois

I am asking this question even through the insident was a long time. I was born in 1962. At 9 months old. I became sick, my mom took me the hospital, this hospital said that their was nothing wrong with me, she took me home. I became sicker she took me to another hospital whicj said this baby is sick and in order for her to live we will have to amputate her right leg and right fingers off. My parents never did anything but I am the one that is suffering all my life from this hospital sending me home. I am just asking is it to late all through mny life people have told me it was to late.

I am afraid they are correct, the time has long since passed for you to file a lawsuit.

In the State of Illinois there is a two year statute of limitations that would have began to run when you reached majority.

The only exception would be if the medical provider intentionally hid the malpractice from you.

Affirmative bad acts would "toll" the statute. However, in my opinion, since it has been 45 years you would not be able to meet your burden of proof and the case would be eventually dismissed unless there was a blatant and egregious situation.
