Legal Question in Medical Malpractice in Illinois

who needs to file

My child had a very serious accident and was not treated properly by a physcian/hospital. I am seeking legal counsel on my child's behalf. My question is: Is it necessary for my former spouse and me to file together? He is not interested in having procedures revised at the hospital, and therefore does not want to seek legal help. I'm not sure if he needs to be an involved party or not. Please help clarify this isssue for me.

So long as you have legal custody of your child, you may bring a lawsuit on his behalf. Your husband need not join in this. Only one guardian/parent need to participate.
