Legal Question in Medical Malpractice in Illinois

Medical legal question

I looked at my medical record and found that. 14 years ago a doctor diagnosed that I have Hepatitis C. He told me I had liver problems from drinking. I found out 12 years later from my present doctor. That was the first I heard of it. The type I have can kill you but there is a cure for it. I think this jerk should have told me I have desease that could kill me, when there is a cure for it. What do you think? I just found this today 01/01/09

Re: Medical legal question

As odd as this sounds, you can't really sue for malpractice unless you suffered some kind of direct harm. So, for example, if you missed your chance to get treatment because of the doctor not telling you, or if you suffered some kind of harm because the disease was not monitored properly then you would have a claim.

As it stands, unless there are professional rules (there may be, that is outside of my area of knowledge) that obligate the doctor to tell you, I do not see you recovering anything.
