Legal Question in Medical Malpractice in Illinois

mishap after surgery

I had my gall bladder removed. The clamp that they used to close the duct failed and fell off. That resulted in my body cavity filling with bile and a 5 day hospital stay. Is there any recourse as far as this is concerned? Do we just pay the hospital bill and forget about it or is someone liable?

It is unfortunate to say the least that you have had such complications following surgery. I hope that you have recovered by now and are doing well. If the surgery was performed within the applicable statute of limitations, you might have a claim against the health care providers based upon negligence, or you might have a claim against the maker of the clamp if it was defective, or both.
