Nursing Home Medical Neglect

My question is in regards to my mother and her recent death. My mother was 79 years old and in a nursing home to get physical rehab for neuropothy in her legs from the knees down to her feet. My mother had been diagnosed with a form of leukemia known as myeloid displasia in 2000. For the past 4 years she had been doing well. In november of last year, 2004, her blood counts dropped dangeriously low. And this made her very open to infection from colds. My mother caught a cold and it went into pneumonia. She went into the hospital in early december and she died january 4th, 2004. Before my mother died, I talked to my concerns about good hygene with the nursing home administrator. She told me that she had a meeting with the staff about that very same thing. My question is, '' Because the nursing staff knew my mothers counts where low, and refused my request to put her into the hospital when very sick and a tempature, until her temp went to 103.0, then they put her in, do I have grounds for a medical neglect suit? And this was after an admission of not using good hygene by the staff.

I think you may have a claim depending on what the medical reports show, how bad your mother's condition had become, what they did at the hospital and what was done at the nursing home prior to the transfer to the hospital, and the nursing home's procedures to deal with your weakened mother.

There are a lot of variables that must be examined before deciding whether a case you may have has any chance of surviving judicial scrutiny.

The best course of action is to get all the medical records from the hospital and take them to an attorney for examination.
