Legal Question in Medical Malpractice in Illinois

Pharmacist puts wrong doseage on label

I got a perscription filled for my 3 month old daughter. Two days later after giving my daughter about 7 doses of the medicine the pharmacist called to let me know that he put the wrong doseage on the label. He put 1 1/2 tsp. instead of 1 1/2 ml. I contacted my doctor and he said that there should be no long term damage, but that she will have stomach irritation, throwing up and diarrea. She has already been throwing up. Is there anything I should do as far as suing the pharmacy?

Re: Pharmacist puts wrong doseage on label

There are no guidelines regarding suing a tortfeasor or not. What you "should" do? You should do what your conscience dictates. What bringing a lawsuit would result in and what is it you think you will accomplish by suing the pharmacist?

Those are the questions you should ponder while deciding whether to consult an attorney for a lawsuit or not.

That is if in fact the injury to your child is of limited extent and confined to few days of vomiting and mild to medium discomfort.

Should that change--that is God forbid your child displays severe symptoms and some sort of permanent life lasting damage as the result of the carelessness of the pharmacists, then, you should talk to an attorney because the situation will be different.

I hope this helps,

good luck-
