Surgery possible gone wrong

I had a complete right elbow replacement in march 2004. Before this surgery, I was able to move my fingers side ways and up and down. After the surgery, the mobilities of my fingers are very limited. On the day of the surgery apparently I was to be able to open my hand. That did not occur. It took weeks. The orthopedic surgeon states that he pulled the ulner nerve ( in his exact words ''he did an oops'') Since then it has not been the same. What can I do. Is this something that I can sue for? My mother keeps telling me that the reasons these surgeons have insurance are for cases like these. It happens. How can I sue. What steps do I take? I need help. Thank you

I am sorry to hear about your injuries.

It is possible that you may have missed the deadline for filing a lawsuit. It is possible that you may still have a chance to file a claim against the doctor--if your medical records show that there was a failure to follow the standard of care in the community in which he practices.

The only way to know that, it to look at the entire medical records from the time before your surgery, and the time after your surgery so as to find out whether there is a claim and if so whether you still have time to file it.
