Legal Question in Medical Malpractice in Illinois

wrong tooth extracted

I went to get my wisdom teeth extracted about 3 weeks ago. I had my bottom right and top right wisdom teeth removed, but now that I'm finally healing, I'm noticing that my top wisdom tooth is still there and I'm missing the molar right in front of it! can I sue him and how?

Re: wrong tooth extracted

Of course you can. If in fact he extracted the wrong tooth AND did not tell you about it, there is a double wammy in my book. You have two causes of action-one in mal-practice and another one in assault and battery (I know, it is strange to talk about assault and battery but the definition of battery falls within the same realm of unauthorized and harmful touching.) I have done many cases against dentists under various theories.

If you need more information, contact me at once. Your case the sort of cases I handle all the time.

I hope this helps-
