Legal Question in Military Law in Illinois

Help my daughter may be going to Captains Mast

I went to visit my daughter this weekend and she left for a couple of hours. She has phase 3 liberty but it was her day to do watch. She had completed her watch when she left. She was gone 2 hours and they are charging her with derelict of duty. She went before a review board today and has to go before a DRB soon. They have told her that she will most definately have to go to Captain's Mast. Is there anything she can do to prevent this? They had a muster while she was gone and that is how they found of her absence. She has been honest and truthful in her replies. Also will this prevent her from going overseas?

Based upon the limited amount of information you posted, it is not possible to give you even any general advice or guidance. To be charged with "Dereliction of Duty," she must have violated some specific duty imposed upon her by lawful authority, a regulation, SOP, directive, Order, etc. Without knowing what that is (or is alleged to be), no lawyer can give proper counsel on your query.

She is entitled to see a Navy JAG Defense Counsel before she has her Mast proceeding and she should by all means do so. If you have any further questions, please either call me or email me privately.

Good luck to you both,

Don Rehkopf
