Legal Question in Personal Injury in Illinois
Need advise on existing suit
I was involved in an accident in 2004. Person involved claimed responsibility. Bac injury accured, cant work per doc's. My attorney is given very little info to me (we get paid if u get paid) no offer, she tells me now that it will go to trial to prove if I am really disabled. This she claims will take another year or 2. I am about to lose everything I had worked for. Could u please tell me if this sounds like it is normal. Insurance co. is involved. I thought after 8 months of therapy and numerous test and no better results that anyone can clearly see that I AM INJURED. I have been approved and recieve disability. But nothing compared to my usual earnings. Thank u 4 your time. [email protected]

Re: Need advise on existing suit
This is normal. The defendant has a right to require you to prove your case in a court of law and has a right to defend the matter. It may be obvious to you that you are injured, but to be legally entitled to a settlement, you must prove, based upon a preponderance of the evidence, that you were injured and that your injury was proximately caused by the defendant's negligence. Good luck!!
