Legal Question in Personal Injury in Illinois
Why is the arbitator award amt is higher and not the same as the amt the attorney gave.
I just dont understand and need some kind of confirmation for myself... From my own research many have stated that the arbitrator is not aware of any policy limitations, so therefore insurance coverage limits does not matter and whatever decision/award amt that granted is the amt to receive. When others have said even if an arbitrator award amt exceed the policy coverage, only the limit amt will be given. (ex. underinsured amt $100k vs. arbitation amt $150K.)
I was not sure which subject to choose: Accident Law or Insurance
Thank you.

You need to ask your attorney about why you are not getting the amount the arbitrator has awarded. You also need to read the contract for arbitration that you signed before getting into the arbitration--likely, the reason will be spelled out in there.
I can only do guesswork based on what you have written.
I hope this helps-
