Legal Question in Personal Injury in Illinois

Assault at local convenience store

I went to Bigfoot gas station and convenience store to purchase alcohol. As I carried out a 12-pack of beer I accidentally knocked over a 6-pack of Bacardi Silver. Three of the bottles broke. After I had cleaned the mess the clerk told me I had to pay for a 6-pack of the Bacardi Silvers. I went ahead and bought the 6-pack. After further thought, I realized that there was no reason for me to buy a full 6-pack under a you-break-you-buy policy. I would only have to buy three. I went back to the store and asked about the issue. The clerk fired back yelling for me to get out. I told him I would not until I received a refund of 3 drinks. The clerk then ran around the corner of the counter and charged me. Another clerk held him back from physically harming me. Do I have a case against this person and for what? What should I do?

You should report it to the police - it sounds like assault.

Re: Assault at local convenience store

You ask what should I do? Sincerely, you should forget about it, and bring your business elsewhere. You already paid for a six-pack, and getting your money back for the three bottles you did not break is not worth your time. As for the clerk charging toward you, you could file a complaint of criminal assault, but that has nothing to do with a civil lawsuit and money damages. you might (repeat: might) have a civil assault charge you could bring, but theres no real money in it for you. Just move on.
