Legal Question in Personal Injury in Illinois

auto accicent injury and property damage

My husband was in a car accident, where a city dump truck went through a stop sign and received a ticket, hitting him on the side of brand new van. He is a golf pro and just had his mri which showed a central protruding disc, for which he needs surgery. There was also 19 thousand dollars for damage to the van, and 6 thousand dollars in rental car bills. I heard that juries do not like to award for damages due to city involvement.

Based on your description, your husband has a valid claim for damages against the city. Depending on how the case is handled, juries are not opposed to awarding appropriate damages to victims of negligence such as your husband. Please feel free to contact my office if you would like to discuss this matter in greater detail.

I'm sorry to hear about your husband's accident. I know how debilitating back injuries can be.

Based upon the facts of the case as you describe them, there's no reason to believe a jury would want to protect the city. Some jurors may, in fact, tend to side AGAINST the city.

Beyond that, when liability is clear, sometimes an attorney can assist you in collecting from the city without the necessity of filing suit. The city may want to avoid bad publicity or the costs of trial.

If you do contact an attorney in Illinois, be wary if they request any fees or payments up front. In your type of case, the majority of reputable attorneys do not collect a fee unless you win.

If you would like to discuss the case in greater detail, please feel free to call me directly.
