Legal Question in Personal Injury in Illinois

Auto accident statue of limitations

Involved in motorcycle accident with auto. Other party admits to fault. How long do I have to settle? What is the statue of limitations on filing suit or reaching settlment?

Re: Auto accident statue of limitations

As a motorcyclist, I am sorry to learn of your crash! Don't be lulled into a false sense of security becaust the other side has "admitted" fault. They can still try to pin some of the blame on you, or argue that you aren't hurt as badly as you claim to be, and refuse to settle fairly.

You have two years to file a lawsuit, but you should never wait that long to make a decision about hiring a lawyer. Remember that the insurance company, even if they pay you, would like to delay that payment as long as possible to continue to "use" the money they owe you. Also remember that preserving evidence, taking statements and the like, becomes more difficult with every passing day. I hope you have pictures of your bike, and you should also get some of the area where you were hit.

If you wish to discuss this matter, without cost or obligation, you can reach my office toll free at 866.621.6519.

Re: Auto accident statue of limitations

Assuming you were over 18 at the time of accident, the statute of limitations is 2 years from the accident date for personal injury, but five years for property damage.
