Legal Question in Personal Injury in Illinois
do i have a case if my obgyn left part of my ovary in after a hysterectomy and caused me pain
1 Answer from Attorneys
Hi. I am an attorney that focuses my practice on personal injury and medical malpractice work throughout eastern Missouri and most parts of Illinois.
I am sorry to hear about the undue stress and pain this incident has caused. Establishing medical negligence is a difficult task, although this act does appear to potentially rise to the level of being a compensable injury. Oversights or failed processes do occur in the hysterectomy context.
There is not quite enough detail here to determine if you have sufficient grounds for a potential claim (or settlement). How long did the pain last for? Was it a dull pain or excruiating pain? Did it result in any time missed from work or inability to perform your normal activities? Very importantly, did you incur any additional medical bills, either to fix the problem or to deal with any other issues that arose, due to the apparent mistake by your doctor?
Also, the potential value of any case you may have will depend on the effects of the act of leaving part of the ovary in. Did you incur any additional side effects besides pain, such as infections, fever, nausea, stomach pain, bladder problems, or kidney infections? These are side effects that are seen with problematic surgeries.
I can be reached via e-mail at [email protected]. Thanks.
