Legal Question in Personal Injury in Illinois
chip tooth on rock found in cereal box
Last night I was eating some cereal and I bit down on something hard, just in my normal way of eating cereal, and I was confused. Out of my mouth I pulled a rock (I don't how to describe it, maybe the size of a dime, but thick, like the size of a disfigured marble). I looked in the mirror and my tooth was chipped (not horribly, but definitely chipped). I still have the rock, and I would like to know how to proceed from here. Is it worth suing, and if so, what is my best way of doing so? Would I get more than just a fixed tooth (you know, like keep quiet bad publicity money) or not? The reason I ask is it seems like a lot of work to sue to only get $100 worth of dental work paid for. Can I sue them without a lawyer? Do I need to visit a dentist for proof, thus laying out money beforehand?

You have a right to recover for your damages from the negligent acts of other people or corporations.
In order to do so, you need to demonstrate that someone else was negligence (careless) and as a result you sustained damages (dental bill).
I would recommend that you take a picture of the rock, contact the cereal company to file a claim and go to the dentist.
Get a written report from the dentist which includes as many details as possible and provide a copy of the same to the cereal company (if possible, a copy of the chart from your last prior visit to the dentist would be helpful in establishing that the cereal/rock caused the damage you now have to your tooth).
Most likely, you would have to pay for the dental work and the cereal company would reimburse you after you submit your proof.
I do not think that your situation would be worth much more than the cost of the dental work, so you would be better served trying to resolve it directly with the cereal company.
Good luck and let me know if you need anymore assistance.
