Re: claim limitations

The insurance company has forever to settle a claim. YOU however, have only two years to make a claim in a court of law. If you miss your two years statute of limitation and no lawsuit has been filed and the insurance company has not settled the claim, you will be out of luck and any claim you may make will be barred forever and for good. You have been rear-ended and I presume you were injured. You need to make a claim either personally or through a lawyer and watch for the two year anniversary of your accident and if the claim has not been settled to file a lawsuit so as to protect your rights. You really should speak with an attorney before you take on the issuance company yourself.

Good Luck,

ACT NOW. DO NOT DELAY. You are losing time.

See a lawyer on this RIGHT AWAY. Illinois statutory law provides that actions for damages for an injury to the person, . . . shall be commenced within 2 years next after the cause of action accrued. This means that you have until October 22, 2002 to settle the case with the insurance company or file a lawsuit against the persons who caused the accident. After that date, you have NO CASE late-filed cases are dead cases. [The insurance company will likely stall you in the hope that you wont file in time.]

See a lawyer as soon as you can. Do not delay. You are losing valuable time. Your lawyer will need a little time to speak with you, investigate the facts, and prepare an appropriate pleading before filing your case.

ACT TODAY.
