Legal Question in Personal Injury in Illinois

My daughter ate a hamburger that had a plastic tab cooked inside of the sandwich. This caused her to choke on the object. She was able to dislodge the plastic form her throat. We drove back to the restaurant and informed the owner what happened. We also showed him the object and he stated that it was a plastic tab that closes his hamburger buns. I informed him that I was going to take my daughter to the emergency room and he understood. He said that he would contact his insurance company and that someone would contact me. It has been over 5 weeks and I have not heard from his insurance company and he is not returning my calls. I have received the bills from the hospital. What can I do legally to address this situation?

If your daughter has completely healed and the expenses were small, you can file a small claims case. If the bills were high and/or she is still having issues, then you may want to hire counsel. You may also want to submit the bills to your health insurer if you have one.
