Drunk Patron Chipped Tooth at Restaurant

I work in a bar/restaurant in Chicago. After work, I stayed to have a beer with a coworker and an extremely drunk patron elbowed me in the mouth as I was sipping my bar, causing my front tooth to chip. I was off the clock. Is the restaurant responsible for paying my dental bill? Thanks.

You may have a workers compensation claim because you were injured while you were still on the job site. Although, there are arguments on both side so whether you win or not is iffy.

However, you do have a dram shop cause of action against the bar owner and the person who owns the property upon which the bar is located. If you meet certain criteria, you are entitled to your medical bills, wage loss, pain & suffering and loss of normal life and any other damages and losses resulting from the acts of the drunk patron.

if you were injured by a patron who became intoxicated at the bar they are liable
