Legal Question in Personal Injury in Illinois
Family member driving my car hit pedestrian
My sister, driving my car, hit a pedestrian yesterday. Person refused treatment at the scene, but now has ''hired an attorney'' and wants to know what I am going to do about it. I'm not sure how to deal with my insurance company and if they will pay claim, since she is not on my policy (although she lives with me). Plus, my sister was issued 5 tickets and we need help with her case.

You should simply turn the matter over to your insurance company. I can help you do so. You should do so in writing. If you learn that the insurance company is not handling the claim, or if the insurance company writes you denying coverage or reserving its right to do so, call me. You can also call me if you have any questions. Larry Stein (630) 221-1755.

I am sorry to learn of your problem. This, however, is why we pay insurance premiums- mistakes happen! The attorney needs to be directed to your insurance company, and neither you nor your sister should speak with the attorney until your insurance company gives the okay.
The insurance company is responsible to defend and pay any judgment, but they also have the right to decide whether to settle the case or fight it in court.
As for your sister's tickets, she needs to get to a traffic lawyer ASAP for a million reasons, not the least of which is the effect of even one traffic conviction on one's driving record.
