Legal Question in Personal Injury in Illinois

My family and I stayed at a hotel and we were bitten by ants. I took pictures and told the hotel management. They came to the room and was looking like wow and they gave us another room. They took pictures of the bites and told me that if i ever needed another room any other time to let them know. I was completely upset and creeped out so we left and didnt even stay another night. The next morning we woke up and I had an allergic reaction to the ant bites and went to the doctor and he confirmed that it was an allergic reaction and he gave me cream and everything. Also my daughters knee started to get bigger where she was bit at. I took her to the emergency room and they said she had to do an outpatient surgery and cut her knee open so they could get the poison out. That was the most horiffic event being in that room with her while that was happening to her. What I am asking is what I need to do from here. Thank you

Hello, In my opinion you have grounds for a lawsuit. I am uncertain as to where and when this happened to you, but assuming the incident happened in Illinois, you should file a lawsuit within 2 years of the incident. First of all find out what the statute of limitations are in the state that this happened. The SOL is a time period in which you either can settle your case or have to file a case in court, usually in the County and State where the incident took place. You should obtain copies of all medical records and the bills and keep whatever photos that you took.. You can either try to settle the case directly with the hotel's insurance company or hire an attorney. Attorneys know what to ask for and how to evaluate your case and will maximize your recovery. Attorneys charge on a no recovery no fee basis.

You need to speak with a personal injury attorney in order to retain representation before you do anything else. From what you have written, you have a claim for personal injury for yourself and your daughter, at least for the cost of the medical treatment incurred, plus all other damages that may stem from the event--some of which may not be known at this time.

All 3 previous answers are good advice. You may want to start with the hotel's insurer and if they are unwilling to negotiate, contact a personal injury attorney immediately.
