If I was not injured in a car accident but my car was totaled and the other driver was cited, Do I still have a case?

Yes--You have a claim for your property damage against the other driver.

Make sure you document the state of your car: take pictures and have an honest body shop declare the car totaled. You will need that documentation for your claim against the other driver's insurance company.

You do have a property damage claim and you should follow the advice that the other lawyers have suggested on here. However, if you need your vehicle repaired quickly and you have insurance coverage, you might want to file with your own company. Doing so, will usually expedite repair and your insurer will then seek reimbursement from the other party. Good luck.
