Legal Question in Personal Injury in Illinois

I was involved in a four car accident. I was in front on the interstate when traffic slowed and came to an halt so I had stopped. so I was car A soon afterwards I was struck by car B in the rear. Car C hit car B they it them hard enough they knocked them into me so I was hit a second time. car D hit car C in the rear also. the trooper came to the scene and listed car B as the at fault driver for causing the accident.

I sustained neck and Back injuries went to the hospital and had Bills totaling just over 10K I had $2200 in lost wages even though I work on salary. I had three estimates from three different shops on how much it will cost to fix my truck the average was $3500 but Car B insurance company only would pay $2700 I Needed to get my truck fixed because I use the back of my truck for moving and transporting often so i called the insurance company Back and told them that My estimates came in at 3500 they told me if they do not pay any more than that so the shop will have to call them for any more work the shop told me that it was just one of there tricks they will have someone come in to say get the work done with used parts to save money and get more wok done so i given up So my question is will I be able to go after both parties individually or will this have to be a combined incident? Car B has already paid 2700 for repairs so I just got the major things repaired and got frustrated with the rest. My question is can I go after Both parties and what would be a fair settlement Do I treat both parties individually or will the total amount be combined? What is the amount of time it will take to go through the court system? and do I go after the individuals after I go after the individuals after I go after the insurance company? this Accident happened in Illinois on the interstate Car B airbag deployed if that gives indication on rate of speed and his car was totaled I never been through this before just need guidance on how to proceed.

You need to hire counsel. This is not an easy and uncomplicated situation with multiple cars, multuple insurers etc. Also, in Illinois, you can not sue the insurance companies directly. Most attorneys will take this kind of case on a contingency basis. In other words you pay them if there is a settlement. Good luck.

I kept reading and was hoping to get to the part where you say you have retained an attorney. This is not something you can do it alone unless you want to get the shaft by the adjusters--as a victim, NO ONE--and that is NO ONE is on your side. Not the doctors, not the mechanics, not the insurance adjuster or your insurance agent(s)--no one. Everyone has something to gain by short changing you. The only person who can make sure your rights and what you have coming is protected is an attorney. No one else. Personal injury work is done on a contingency basis--that is the attorney's fee is paid out of the proceed of any settlement/verdict he can get for you (and that is why you can trust the attorney because more money you make, more money he makes). Generally you do not pay anything and if there is nothing collected you pay no fees.

The best advice I can give you is to consult with an attorney. If you want more information, you may call me at my office-I will be more than happy to talk to you about your case further.

Good luck-

Nima
