I was involved in a chain reaction collision involving 4 cars I was car A. driving on the interstate traffic was conjested came to a stop i was stopped behind the car in front of me when I was rear ended pretty hard by car B.an SUV smashed in my rear lift gate on my truck and put a dent in my Bumper he totaled out his SUV then he was rear ended by car C. and was knocked into me were i was hit a second time I suffered neck and back injurys then she was rear ended by car D. which were more minor. I sustained 10k in medical and 2k in lost wages so since I was hit twice will I be able to go after both parties? I am still having aches an pains after 2.5 months I was told that the pain should go away after a while. and what would be a fair settlement.

First, I am sorry to hear about this ordeal.

Two, if you think you will get a fair settlement doing this by yourself (I hope not but you seem to be going it alone) I am sorry to tell you that you will be disappointed.

Three, why not going after all the persons who have caused an impact on you. Whether minor or major, it makes no difference.

WIth $10k in medical and $2k in WL, form what you tell me--and it may not be the entire story and you may have left some important details out--I think a settlement in the amount of $42,000 to $52,000 would be fair.

I hope this helps and best of luck-don't let the insurance adjusters talk you into taking short money.

Wow, I am absolutely amazed that the other counsel who responded to this case can make any suggestion of a fair amount for settlement without having spoken to you, learned about your work, your hobbies, how this may have impacted on your family, what you can and cannot do now since the accident, what is in the police, the police report or your medical records and that you are still having pain after two months. The general rule in medicine is that unless the pain goes away in 6 months, its chronic and likely to stay a long time. I would not suggest settling any case before th 6 month period is up since you are still having pain. Keep in mind, you can only settle once, so if you settle now and it turns out that your problem is chronic, you cannot go back later and ask for more.

Based on the information provided you certainly can sue at least b and c. I would want to see the police report before rendereing any opinion on d.

Good luck.
