Little League Baseball injury

My 13-year-old son suffered a depressed skull fracture and traumatic brain injury after colliding with his teammate during a league baseball game in a public park. Am I entitled recover any of the huge medical expenses we have endured?

I have to apologize for my colleague's non-answer to your very real concern.

The answer to your question depends on some facts that you have not provided. Under normal circumstances collecting damages for these type of incident is very remote. However, was your son provided with adequate protection? If not, did anyone protest this situation? Where did the game take place--at what time- Was there previous incidents like this that had occurred? I have many other questions that needs answer before providing you with an intelligent assessment of whether or not you stand a chance to collect damages.

The key concept in your case is that of negligence. Generally speaking, in order to recover money damages in a lawsuit, you would have to show that someone did something wrong, something that an ordinary reasonable person would not have done, and that led to your son's injury. Without more details, it is difficult to answer your question.

One avenue you may look into is whether the organization had insurance coverage that provied for "no fault" medical coverage. If they have this coverage, there may be some money from the insurance company to cover some of your medical bills, without having to prove that anybody did anything wrong.
