legal action against daycare
I'm trying to find out if I have any grounds for legal action against my daughters daycare and if there is a statute of limitations to file any action. I found out that the assistant director of my daughter was having an affair with my husband. It had been going on for 1.5 years. The daycare is a National accredeted daycare that has huge ethics and betterment of the child reputation. An agent of the school knowingly entering into an affair which led to the breakup of the family life of a child in their care seems to be contrary to their ethics. Also, but this part is hearsay from the assistant directors husband said that she was on medication for mental issues and probably shouldn't have been working with children and that the director of the daycare knew about the affair for over a year. The director allowed her to change her schedule to have 3 hour lunches to meet my husband during the day and she worked past the daycare's hours.

You do have a cause of action against the woman involved. You may have a cause of action against the company, but I would need to see more of the evidence to tell you.

You definately have legal grounds against the daycare employee and on the information presented, it sounds as if you can also go against the Daycare, personally. It also sounds as if you may be able to seek damages on behalf of your child agaisnt the daycare if you can document damages for her. You should contact an attorney to set up a consultation as a complete explanation of possible rights is too difficult to give in this forum.
