How long after a car accident does a person have to claim injury?? I was hit from the back. I said I felt all right- at the time(3 weeks ago) but now am having extreme stiffness and pain in neck and shoulders.
Could you please explain the proceedure on filing a claim??

Generally you have two years from the date of the accident by which time you must have filed a lawsuit. Three weeks after the accident you should be OK. The procedure is to make a claim wither with your own insurance or that of the other driver.
You would do yourself a huge favor if you go ahead and talk to an attorney first. Generally, the first consultation is free and these sort of cases are taken on contingency--that is you need not pay anything and there will be no fee if there is not a recovery.

A claim can be filed with the insurance company of the other driver just by talking with them. You can choose to hire an attorney to do this.

Generally you have two years from the date of the accident by which time you must have filed a lawsuit.
In the meantime if you need your medical bills paid right away you should make two claims, one under your medical payments coverage from your own insurance company. They will pay the mediocal expenses immediately.
At the same time, you should submit a claim against the other driver's iinsurance company. they will take some time to determine what they consider to be a fair offer to you.
Your claim against the other insurance company's driver is based generally on your pain and suffering , medical expenses, disability and lost wages.
