medicare reimbursement

My attorney wants me to settle

a lawsuit and sign a release

without going to court.He

wants to hold 50% of the

settlement in escrow to repay

medicare. Can't I be

responsible for that myself and

who notifies medicare? The

amount I totaled from my

records is less than 1/4 of the

amount they want to keep?

No. However, you can ask your attorney why 50% is being held instead of 25%. Also, you attorney should be able to obtain a reduction in the lien. This is cusomary and medicare has a formula for such a circumstance.
