Legal Question in Personal Injury in Illinois

My mother was killed 7 months ago in a car accident, the police report states she is at fault. The Insurance paid 1/4 of funeral expenses and paid the accidental death coverage we had. Should they pay for anything other than those? Should I seek legal advice?

Yes you need legal advice, in part because the facts you present are scanty and there may be much more, and because if the car and insurance were your mom's, then her estate needs to address them, esp. if she left a will. But just so you know, auto insurance policies are really a combination platter of different coverages. For example, if the car had collision or comprehensive coverage, then the insurance company should pay something on the car (usually actual cash value less deductible), and if anyone else was injured or she damaged anyone else's property and she is considered at fault, then the liability portion should cover those damages. As to the funeral expenses that may have been under the medical payments portion which is usually nominal.

You are already asking for legal advice! There are so many thing to look at and you have given so little information that it is almost imperative that you speak with an attorney to review all the facts and find out what it what. Further, that the police report says it was your mother's fault is almost irrelevant-I like to review those facts and decide whether why the police who did not witness the accident would say that.
