Legal Question in Personal Injury in Illinois

I have a personal injury claim that a workers comp policy wants reimbursement from. IL law states they are entitled to 75% of what they paid out. Should they then share my legal expenses since they are getting money back due to my suing the other party?

That 25% is what they are paying out for your troubles. Otherwise, they would be entitled to the 100%. They also have to share in the expenses of the lawsuit-filing fees, summons, etc...

They have to share in the litigation expenses, but not your attorneys fees.
