Legal Question in Personal Injury in Illinois

My mother tripped on the threshold of the door while she was leaving a Dunkin Doughnuts store. She fell to the outside of the building. Safeco insurance who is Dunkin Doughnuts insurance company tells her that they are not liable for her medical bills because she fell to the ground on the outside of the building. I feel that since that the fall was caused by the trip in the store they should be responsible for her bills.

If she tripped on the threshhold the fact that she fell outside should not matter. Slip and fall cases are very difficult. We would need to investigate exactly why she tripped, whether there was a dangerous condition, and whether Dunkin Donuts knew about it.

The issue is whether the height or some other condition of the threshold was unreasonably dangerous for the patrons of the Dunkin Donuts. Most insurers deny liability, so your posting does not surprise me.

There may be a number of reasons why your mother tripped. lighting could have been bad, the threshold too high; she may have been trying to avoid something else that was dangerous, etc.
