Legal Question in Personal Injury in Illinois

Personal injury

I slip and fell and broke my ankle @ a gas station on 02/26/07. I had an attorney handeling my case but it never lead anywhere. I wanted to know if its to late to act on a suit or possiably get another lawyer to take my case.

As a general rule in slip and fall cases in the State of Illinois, you have at least two years or until 02/26/2009 to file a lawsuit.

When you say your case "never led anywhere" what do you mean?

The lawyer never initialed a claim?

The lawyer initialed the claim and never followed up?

You certainly can discharge your current attorney and retain new counsel now, or at anytime.

I am curious as to what you mean by the case not leading anywhere? Have you spoken with your lawyer? Has he explained what are the things he has done? Perhaps your claim was denied and you have bad liability. Just because there are injuries it does not automatically mean that the other side has to pay you. Slip and fall cases are generally difficult cases because there is always a component of contributory negligence involved.

From the date you have given, you still have time to file a lawsuit and pursue the matter in court. But the decision to do so depends on the facts of your case and the how of your fall and other factors.
