personal injusry due to car accident.
I am a 24 year old hair stylist, I was injured in a head on collision that was completely unargualbly the other drivers fault, witch left me with two herniated disks and severe nerve damage thruout my back and neck. I have been unable to work since the accident and am involved in therapy 3 days a week. I am still in alot of pain, and as much as i want to, i can not do my job. I am completely out of money and having trouble paying my bills unrelated to the accident. I live at my parents house, but if I didnt I would be living on the streets by now, What am i supposed to do for money until I get a settlement?? Also, before the accident I have been on a very regimented diet plan and i lost 50 lbs, now that im hurt i can not work out, i can not afford the healthy groceries i was buying for myself and i am completley depressed over this whole ordeal, I hate the way i look now that i feel like i may gain the weight back, I feel depressed and full of anxiety because i can not work out. Is all this mental pain also going to come into play with the lawsuit against the person who hit me? becuase it is a direct result of the accident.

You need to file a lawsuit against this driver and any employer of this driver if this person was operating a car in the course of employment.
Also, we would need to consider an underinsured motorist claim as well as a claim against any other potential defendants.

If you have a pending lawsuit you most likely have a legal counselor...have you spoken with your attorney about these problems? He or she should be able to answer your questions, provide you some time lines and the guidance you need. You need to open a line of communication with your current attorney and if he or she does not cooperate you should insist upon a face to face meeting or new counsel.
Often attorneys do a lot of work and are poor communicators. Reach out to them and I am sure they will quickly and fully provide you with better answers than an online forum. Good luck!!

Really sorry to hear about your situation.
You are so young to be going through such
an ordeal. As a hairdresser, your work is obviously
affected. Hang in there.
Your injuries have caused a complete
change in your physical and emotional
health. Under the law you are entitled
to recover for pain and "suffering."
If you are having a diagnosable depression,
evidence of that condition would go into
evidence and be argued as damages by your attorney.
Insurance companies notoriously dismiss such
claims. You need to have clear evidence of your
damages put forth by a strong advocate.
Settlements most typically are lump sum payments
made at the end of the case. Funding companies
exist which make short term but high interest loans
to injury claimants.
You need an experienced, aggressive and compassionate attorney.

You certainly are a victim of a bad situation. It sounds like you are doing every thing you can to get better and that is always the best approach to take in an injury case.
Unfortunately, you are in a circumstance that is what I call the Insurance- created purgatory of injury cases, the time in between the injury and the settlement or trial of a case. In Illinois, there is no temporary settlement, the reason being that the insurance companies of the defendants hold out as long as they can, hoping that they will force an injured victim to settle a case early for pennies on the dollar.
In Illinois, you are entitled to damages based on pain and suffering, lost wages, future lost wages, temporary and permanent disability, disfigurement, andpast, present and future medical expenses. Based on your submission, your anxiety, depression and physical changes due to the collision appear to fit into multiple damage catagories.
It is unclear to me whether you are represented by counsel, yet. If you are, your best bet is to contact your attorney as he or she has the most knowledge of your case and are in a far better position to guide you than any advice that you can get in Lawguru or any similar forum and in relating your symptoms to areas of damages.
