Yes, you can absolutely pursue a case against an illegal with no insurance. Of course, this assumes several things. First, that the person you want to sue was at fault for the accident and that you were injured as a result. These seem likely. Second, and more importantly, is whether you have automobile insurance, so that you can make an uninsured motorist claim. For example, if you are rear-ended by the uninsured, illegal, you can make a claim for your injuries on your auto policy. Otherwise, you will be chasing an uninsured person that likely can't afford to pay for your medical bills, injuries, etc.

I hope this answer helps. I am happy to discuss this with you offline (and we can exchange numbers as well). It would help to know more facts, like how bad your injuries are, when did accident occur (2 year statute of limitations), are you the only one injured, how and where did accident happen, etc. Also, what happened to the illegal, uninsured driver...did he get arrested, flee, etc. The key to this will be your own insurance situation or that car you were driving had insurance. Limits could also be important. I can handle case or refer you depending on facts. My email is [email protected]. Alex
