I received a subrogation notice from the other drivers insurance company, can they come after me?

I was involved in an accident on 11/5/09. Apparently I paid my insurance late that month and my coverage lapsed on 11/2/09. The other insurance company is trying to get $4000 in damages to the other vehicle back from me. The other driver states I was pulling out of a fire lane which I was not when she struck my vehicle. The front of her car hit the side of mine. Based on this her insurance has placed me at fault. Will they really sue me for this or will they let it go because it is a relatively small amount. All they currently have is a name and an address, can they actually find me? What is my best course of action?

Yes they can actually come after you for the money.

This is done often by the insurance co.

Yes-the amount of the money is not small enough for them to write it off. In fact, I have seen suits filed for damage as low as $600! So, $4000 is likely that a suit will be filed and they will come after you and anything you own to collect.

You should look into either talking to them and settling the case or get an attorney to do that for you and eventually defend you--if you want to defend yourself.

Unfortunately, they can come after you and will. Under the Financial Responsibility Laws, you could lose your license, so negotiate with them and see if you can reach a compromise figure and payment plan. Explain why their insured was at fault and or partially at fault.
